1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Hetal Novelty ("Company," "we," "us," or "our"), with its principal place of business at Shop 19, Tech Park Commercial Hub, Gachibowli Main Road, Hyderabad, Telangana 500032, India.

By visiting our store, placing an order, using our website (hetalnovelty.shop), or engaging with our digital channels, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or display at our store. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.

2. Our Services

Hetal Novelty provides retail and wholesale novelty gifts, personalized merchandise, custom gifting solutions, corporate gifting services, home décor items, and related products and services. Our offerings include but are not limited to:

• Retail sale of novelty items, gifts, and decorative products from our physical store.
• Personalization and customization services including name engraving, photo printing, and custom messaging.
• Bulk and corporate gifting solutions for businesses, events, and organizations.
• Wedding and festival favor packages with custom design options.
• Online ordering and Pan India delivery services.
• Gift wrapping, packaging, and presentation services.
• Product consultation and gifting advice by our expert team.

We reserve the right to modify, suspend, or discontinue any product or service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

3. Orders, Pricing & Payment

3.1 Placing Orders

Orders may be placed in-store, by phone at +91 97178 13579, by email at info@hetalnovelty.shop, or through our online platform. All orders are subject to availability and acceptance by Hetal Novelty. We reserve the right to refuse or cancel any order at our sole discretion.

3.2 Pricing

All prices displayed are in Indian Rupees (INR) and include applicable GST unless otherwise stated. Prices are subject to change without prior notice. The price applicable to your order will be the price at the time of order confirmation. Bulk and corporate order pricing is subject to separate negotiation and quotation.

3.3 Payment Terms

• We accept cash, UPI, NEFT/RTGS bank transfers, credit/debit cards, and online payment methods.
• For custom and bulk orders, we require a minimum 50% advance payment at the time of order placement.
• Balance payment must be cleared before or at the time of delivery/collection.
• Corporate clients may be eligible for credit terms subject to prior agreement and credit approval.
• All payments are non-transferable and non-assignable to third parties.

3.4 Order Confirmation

An order is considered confirmed only after we send you a written order confirmation via email or WhatsApp. Verbal agreements are not binding unless followed up with written confirmation from our side.

4. Customization & Personalization Policy

Hetal Novelty offers extensive customization and personalization services. By placing a customization order, you agree to the following terms:

4.1 Customer Responsibilities

• You are responsible for providing accurate, complete, and legally permissible content for customization, including names, images, messages, and designs.
• You confirm that you have the right to use any images, logos, or copyrighted content submitted for customization purposes.
• Hetal Novelty shall not be liable for errors in customization resulting from incorrect or incomplete information provided by you.
• Please review all customization proofs carefully before approving production. Once approved, we cannot be held responsible for errors.

4.2 Prohibited Content

We reserve the right to refuse customization requests that include content that is offensive, defamatory, obscene, illegal, or in violation of third-party rights. Such refusals will not entitle you to any refund of advance payments.

4.3 Design Approval

For all customized orders, a digital proof will be shared for your approval before production begins. Production will only commence after your explicit written approval. Changes requested after approval may incur additional charges.

5. Delivery & Shipping Terms

5.1 Delivery Timelines

• Standard orders: 3–7 business days within Hyderabad; 5–10 business days Pan India.
• Customized orders: 7–14 business days from design approval, depending on complexity.
• Bulk and corporate orders: As per individual order agreements and timelines.
• Express delivery options may be available at additional cost, subject to availability.

5.2 Delivery Conditions

Delivery timelines are estimates and not guarantees. Hetal Novelty shall not be liable for delays caused by logistics partners, natural events, government actions, strikes, or other factors beyond our reasonable control. Risk of loss or damage passes to you upon delivery to the shipping address provided.

5.3 Shipping Charges

Shipping charges are calculated based on order weight, dimensions, and delivery location. Free shipping may be available on qualifying orders above a specified order value. All applicable shipping charges will be clearly communicated at the time of order confirmation.

6. Returns, Exchanges & Refund Policy

6.1 General Return Policy

We want you to be completely satisfied with your purchase. If you are not satisfied, please contact us within 7 days of receipt of your order.

6.2 Eligible Returns

• Products that are damaged, defective, or significantly different from what was ordered.
• Non-personalized products in original, unused condition with all packaging intact.
• Wrong items delivered due to our error.

6.3 Non-Returnable Items

• Personalized, customized, or engraved products (unless defective or incorrectly produced).
• Products that have been used, damaged by the customer, or returned without original packaging.
• Items marked as "Final Sale" or "Non-Returnable" at the time of purchase.
• Digital design files and proofs.

6.4 Refund Process

Approved refunds will be processed within 7–14 business days to the original payment method. Shipping charges are non-refundable unless the return is due to our error. For bank transfers, refunds will be made to the account from which payment was received.

7. Communication Consent & Notification Policy

These communications may include order updates, service notifications, promotional offers, new product announcements, seasonal campaigns, and important business communications. You agree to our Privacy Policy with respect to the collection and use of your contact information for these purposes.

You may opt out of marketing communications at any time by:

8. Intellectual Property Rights

All content on our website and marketing materials, including but not limited to text, images, graphics, logos, product photographs, design layouts, and software, is the property of Hetal Novelty or its content suppliers and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, transmit, reuse, re-post, or use the content of our website or marketing materials for public or commercial purposes without the express prior written permission of Hetal Novelty.

When you submit customization content (images, text, logos) to us for personalization, you grant Hetal Novelty a non-exclusive, royalty-free license to use such content solely for the purpose of fulfilling your order. We will not use your customization content for any other purpose without your explicit consent.

9. Limitation of Liability & Disclaimer

To the maximum extent permitted by applicable law, Hetal Novelty, its directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or other intangible losses, arising from:

• Your use of or inability to use our products or services.
• Delays in delivery due to circumstances beyond our control.
• Errors in customization resulting from incorrect information provided by you.
• Any third-party actions, including logistics providers and payment processors.
• Unauthorized access to or alteration of your transmissions or data.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount paid by you for the specific order giving rise to the claim.

10. Prohibited Activities

You agree not to engage in any of the following activities when interacting with Hetal Novelty:

• Providing false, misleading, or fraudulent information in connection with any order or communication.
• Using our services for any unlawful purpose or in violation of any applicable laws or regulations.
• Submitting customization content that is illegal, offensive, defamatory, or infringes on the rights of third parties.
• Attempting to disrupt or compromise the integrity or security of our website or systems.
• Engaging in price manipulation, coupon fraud, or any other deceptive commercial practices.
• Reselling our products without prior written authorization from Hetal Novelty.

Violation of these prohibitions may result in immediate termination of your account, cancellation of orders, and we reserve the right to pursue legal action as appropriate.

11. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

Before initiating any legal action, you agree to first attempt to resolve any dispute amicably by contacting us at info@hetalnovelty.shop. We will make reasonable efforts to resolve disputes within 30 days of receiving your complaint in writing.

In the event that amicable resolution is not possible, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996 of India, with the seat of arbitration in Hyderabad.
